$11 Million Awarded by CA Jury in Mesothelioma Wrongful Death Suit
Another family has been reimbursed by the court for the mesothelioma death of a loved one who was exposed to dangerous asbestos particles on the job.
A California jury awarded $11 million in damages to the family of a former heavy duty vehicle mechanic last week, following a wrongful death lawsuit filed after the man was diagnosed with mesothelioma cancer related to asbestos exposure. The jury decided against Pneumo Abex LLC on January 15, in a second trial over the death of Gordon Bankhead, who was diagnosed with mesothelioma after being exposed to asbestos while repairing and servicing heavy duty vehicles from 1994 to 1999. The first trial in the wrongful death suit established that Pneumo Abex was liable for Bankhead’s asbestos exposure, and the purpose of this second trial was to determine how much the company would be asked to pay his widow. If you believe you have been adversely affected by asbestos exposure on the job, resulting in mesothelioma cancer or another serious illness, consult a qualified lawyer in your area to discuss your possible compensation options.
Harmful Effects of Asbestos Exposure
Mesothelioma is a rare but deadly type of cancer most often caused by the inhalation or ingestion of asbestos dust or fibers. Because the disease has a latency period of 30-50 years and is typically at a very advanced stage when a diagnosis is made, mesothelioma has a poor prognosis and is associated with a very short life-expectancy. Prior to his death, Gordon Bankhead worked as a “parts man” who regularly dealt with, and was present at the grinding and blowing out of, asbestos-based brakes manufactured by the defendant, Pneumo Abex. According to the wrongful death complaint brought by Bankhead’s family, Pneumo Abex knew that the asbestos in its parts could be harmful to human health, but failed to provide sufficient warnings to those who worked closely with the potentially dangerous products.
