Medtronic Infuse Bone Graft Litigation Continues to Grow
Medical device maker Medtronic faces a growing number of complaints filed over the alleged side effects of its Infuse bone graft product.
Lawsuits filed over side effects of Medtronic’s Infuse bone graft product continue to mount, with one recent complaint filed on behalf of close to 100 patients, all of whom allege that they sustained serious injuries caused by excessive bone growth around the spine. Medtronic Infuse is a newer type of bio-engineered bone graft product that has been promoted as an alternative to traditional spinal fusions, which involves bone being harvested from another part of the body or from a cadaver. Infuse is surgically implanted where new bone growth is needed, and the product attracts the body’s own bone-building cells to the site, allowing new bone to be formed over time. Unfortunately, Medtronic has been accused of promoting its Infuse device for off-label use in the cervical spine, which may increase the risk of complications associated with bone overgrowth, including nerve damage, airway compression and difficulty breathing, swallowing or speaking.
Possible Complications Linked to Infuse
One of the most recent Medtronic Infuse lawsuits was filed on October 1 in the 22nd Circuit Court in St. Louis, Missouri. The complaint involves 98 different plaintiffs who allege that they suffered a variety of injuries caused by the Medtronic Infuse bone graft, including uncontrolled bone growth, airway compression, nerve damage and breathing difficulties. According to the lawsuit, the injuries occurred because Medtronic failed to warn patients and the medical community about the risks associated with its Infuse device, and then promoted the use of Infuse in procedures that went against the recommendations of federal regulators. Medtronic has also been accused of concealing safety information about the risk of complications associated with off-label Infuse use.
