A consumer class action was brought against Ortho-McNeil-Janssen, et al in 2010, by two Philadelphia Municipal union health and welfare benefit plans to recover the money they and other health benefit and prescription plans paid for fentanyl pain patches that were recalled because of a manufacturing defect. The lawsuit came after the February 2008 recall of fentanyl pain patches, issued because of the potential for defective patches to release fatal amounts of the medication.
